The Services are operated by Hunter Industries Incorporated, referred to as “Hunter,” “we,” “us” or “our.”

The Services are hosted and supported by Shopify.

By accessing or using the Services, creating an account or submitting an order, you agree to these Terms and the policies incorporated into them.

If you do not agree to these Terms, do not use the Services.

These Terms contain warranty disclaimers, liability limitations and other provisions that may affect your legal rights. Nothing in these Terms limits a right that cannot legally be waived or restricted.

A parent or legal guardian is responsible for a minor’s authorized use of a device, account or product.

Unless Hunter provides written permission, the Services are intended for end users and authorized purchasers.

5. Prohibited Conduct

You may not use the Services to:

Violate a law or regulation
Commit fraud
Submit false order, account or payment information
Infringe intellectual property or privacy rights
Harass, threaten or harm another person
Introduce malicious code
Interfere with security or operation
Circumvent technical restrictions
Attempt unauthorized access
Collect another person’s personal information without authorization
Send spam or unauthorized solicitations
Impersonate another person or organization
Scrape, extract or copy Website content through unauthorized automated methods
Use automated agents in a manner that conceals their identity, bypasses access controls or disrupts the Services
Resell or export products in violation of law or an applicable purchasing restriction

Hunter may use technical measures to prevent prohibited automated access.

6. Product Information

Hunter makes reasonable efforts to display accurate product information, including:

Descriptions
Images
Specifications
Compatibility
Package contents
Pricing
Availability

Product information may occasionally contain errors or become outdated.

Colors and appearance may vary based on the device, display settings, packaging version or product revision.

Product images may be representative and may not show every included component.

You are responsible for reviewing product numbers, specifications, compatibility requirements and installation instructions before purchasing.

Hunter may update, modify or discontinue a product without notice.

7. Orders and Acceptance

Submitting an order is an offer to purchase the products listed in the order.

An automated order confirmation acknowledges receipt but does not necessarily mean that Hunter has accepted the order.

Hunter may refuse, limit or cancel an order for reasons that may include:

Product unavailability
Pricing or description errors
Suspected fraud
Unauthorized payment
Purchase quantity limits
Shipping restrictions
Incorrect customer information
Violation of these Terms
Resale or export concerns
Technical errors

If Hunter cancels an order after payment has been collected, Hunter will refund the cancelled amount to the original payment method unless another method is required by law.

Hunter may contact you using the email address, telephone number or billing information provided with the order.

8. Order Changes and Cancellations

Orders are processed quickly. An order change or cancellation is not guaranteed after submission.

Use Customer Account or the Hunter Helper Chat Bot promptly if you need to:

Change an address
Remove an item
Cancel an order
Correct customer information

Hunter will make reasonable efforts to accommodate a request before fulfillment begins.

Once fulfillment or shipment has begun, an order may need to be handled under the Returns and Refund Policy.

9. Purchase Limits and Resale

Hunter may limit quantities available for purchase by:

Household
Account
Payment method
Shipping address
Product
Order

Hunter may cancel orders that appear intended to evade purchasing restrictions.

10. Prices, Promotions and Taxes

Prices are shown in US dollars unless otherwise stated.

Prices, discounts, promotions and availability may change without notice before an order is accepted.

The price charged will be the price displayed during checkout, subject to correction of an obvious error.

Applicable taxes, shipping and handling charges will be displayed during checkout when reasonably available.

When promotion terms conflict with these Terms regarding the promotion, the specific promotion terms control.

11. Payment

Available payment methods are displayed during checkout.

Payments may be processed through Shopify, Shop Pay or another payment provider.

You represent that:

You are authorized to use the selected payment method
Billing information is accurate
Charges submitted for an authorized purchase will be honored

An authorization or temporary hold may occur before final payment processing.

Hunter may cancel an order if payment cannot be authorized or if fraud is suspected.

Payment providers may apply their own terms and privacy policies.

12. Shipping Regions

The Website ships products only to eligible addresses within the 50 United States.

Hunter does not currently offer delivery to US territories or international addresses unless expressly stated during checkout.

Shipping options may vary by address, product size, carrier availability or other operational factors.

13. Shipping and Delivery

Processing and delivery dates are estimates unless Hunter expressly guarantees a date in writing.

Hunter will make shipping representations based on information reasonably available when the order is placed.

If Hunter cannot ship within the stated period or another legally applicable period, Hunter will provide any delay notice, consent request, cancellation opportunity or refund required by applicable law.

Carrier tracking may not update immediately after shipment.

Delivery can be affected by:

Weather
Carrier operations
Natural disasters
Labor disruptions
Address problems
Security restrictions
High order volume
Events outside Hunter’s reasonable control

Hunter is not responsible for a carrier delay to the extent permitted by law but will provide legally required remedies relating to Hunter’s shipment obligations.

14. Shipping Addresses

You are responsible for providing a complete and accurate shipping address.

Use the Hunter Helper Chat Bot immediately if an address is incorrect.

Hunter cannot guarantee that an address can be changed after fulfillment begins.

You may be responsible for additional shipping costs resulting from:

An incorrect address
An incomplete address
A refused package
A failed delivery
A package returned to Hunter

This does not apply when the issue was caused by Hunter or where applicable law requires a different result.

15. Title and Risk of Loss

Unless applicable law or written terms provided during checkout state otherwise, title and risk of loss transfer to you when the order is released to the carrier.

Use Hunter Helper Chat Bot promptly if tracking states that an order was delivered but the package cannot be located.

16. Returns and Refunds

Eligible products may be returned within 30 days after delivery in accordance with the Returns and Refund Policy.

Unless the Returns and Refund Policy states otherwise, returned products must be:

Unused
Uninstalled
Unopened
In the original packaging
Accompanied by proof of purchase

Customers are responsible for return shipping costs unless:

Hunter shipped the wrong product
A product arrived damaged
Applicable law requires Hunter to pay
Hunter agrees otherwise in writing

Returns must be authorized before shipment.

Refunds are issued 5-7 business days after Hunter receives and inspects the returned product.

Refunds are generally made to the original payment method. Return shipping cost is deducted from final refund total.

17. Damaged, Defective, Missing or Incorrect Products

Use the Hunter Helper Chat Bot if an order arrives:

Damaged
Defective
Incomplete
Incorrect

Provide:

Order number
Description of the issue
Photographs of the product
Photographs of the packaging
Other information reasonably needed to evaluate the request

Hunter may provide an appropriate remedy based on the circumstances, applicable policy and applicable law.

Possible remedies may include:

Replacement
Refund
Return authorization
Missing component shipment
Troubleshooting assistance

Do not discard the product or packaging until Hunter provides instructions.

18. Installation and Product Use

You are responsible for determining whether a product is appropriate for your project.

Follow all product instructions, warnings and specifications.

Irrigation products may require:

Correct water pressure
Appropriate electrical work
Backflow prevention
Drainage
Weather protection
Winterization
Programming
Permits
Compliance with local codes and water use requirements

Use qualified irrigation, plumbing, electrical, engineering or other professionals when appropriate.

Hunter does not provide installation, engineering, plumbing, electrical or contracting services through the Website unless expressly stated.

Improper installation, modification, use or maintenance can result in product failure, water damage, property damage, electrical hazards or personal injury.

19. Intellectual Property

The Services and their content are owned by Hunter, its affiliates, licensors or other rights holders.

Trademarks
Product names
Text
Images
Graphics
Videos
Audio
Manuals
Reviews
Icons
Software
Page designs
Selection and arrangement of content

You may use the Services for lawful personal shopping and informational purposes.

You may not reproduce, modify, distribute, publicly display, publish, sell, license, create derivative works from or commercially exploit protected materials without written permission.

Hunter names, logos, products, designs and slogans are trademarks of Hunter or its affiliates.

Shopify names and marks belong to Shopify.

All rights not expressly granted are reserved.

20. Third Party Services and Links

The Services may provide access to third party:

Payment services
Shipping services
Customer tools
Applications
Links
Content
Social media features

Third party services are governed by their own terms and privacy policies.

Hunter does not control independent third party services and is not responsible for their content, availability, security or practices.

Use of third party services is at your own discretion.

21. Relationship With Shopify

Shopify provides the ecommerce platform that enables Hunter to offer the Services.

Products purchased through the Website are sold by Hunter, not Shopify.

Shopify is not responsible for fulfilling Hunter orders or providing remedies relating to products sold by Hunter.

This section does not limit rights you may have directly against Shopify under Shopify’s own terms or applicable law.

22. Privacy

Hunter’s collection, use and disclosure of personal information is described in the Privacy Policy.

Shopify may process certain personal information under Shopify’s own privacy notices.

Review the Privacy Policy before submitting personal information.

23. Reviews, Feedback and Other Submissions

If you submit a review, photograph, suggestion, idea or other content, referred to as “Submitted Content,” you grant Hunter a nonexclusive, worldwide, royalty free, transferable and sublicensable license to use, reproduce, modify, publish, translate, distribute and display the Submitted Content for operating, improving and promoting Hunter products and Services.

This license continues for as long as reasonably necessary for those purposes, subject to applicable privacy and consumer protection laws.

You represent that:

You own or have permission to submit the content
The content is accurate based on your experience
Required incentives or compensation have been disclosed
The content does not violate another party’s rights
The content is not unlawful, deceptive or malicious

Hunter may moderate or remove Submitted Content but is not required to do so.

Hunter is not required to keep unsolicited ideas confidential, pay compensation or adopt a suggestion.

24. Suspension and Termination

Hunter may suspend or terminate access when reasonably necessary to:

Protect the Services
Prevent fraud
Address unlawful activity
Enforce these Terms
Protect Hunter, customers or third parties

Termination does not eliminate payment or other obligations that arose before termination.

Provisions that should reasonably survive termination will remain effective, including intellectual property, warranty disclaimers, liability limitations and dispute provisions.

25. Website Disclaimer

To the fullest extent permitted by law, the Website and its online features are provided on an “as is” and “as available” basis.

Hunter does not guarantee that the Website will:

Always be available
Operate without interruption
Be completely secure
Be free from technical errors
Meet every customer requirement
Be free from harmful code

Hunter does not disclaim an express product warranty solely through this Website disclaimer.

Some jurisdictions do not permit certain warranty disclaimers. In those jurisdictions, a disclaimer applies only to the extent permitted by law.

26. Entire Agreement and Policy Priority

These Terms and the policies incorporated into them form the agreement between you and Hunter regarding the Services.

When documents conflict:

The Privacy Policy controls regarding collection, use and disclosure of personal information
Product specific written warranty terms control regarding that warranty
Promotion terms control regarding the applicable promotion
The Returns and Refund Policy controls regarding return eligibility and procedures
These Terms control regarding general use and purchases through the Services

27. Changes to These Terms

Hunter may update these Terms to reflect changes to the Services, business practices or legal obligations.

The revised Terms will be posted with an updated “Last updated” date.

Hunter will provide additional notice of material changes when required by law.

Changes apply prospectively from their effective date unless applicable law permits otherwise.

28. Headings

Headings are provided for convenience and do not change the meaning of these Terms.

29. Limitation of Liability

To the fullest extent permitted by applicable law, Hunter Industries Incorporated, its affiliates, officers, directors, employees, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of the Services or any product purchased through the Services, including but not limited to:

Loss of profits, revenue, or anticipated savings
Loss of data or business opportunity
Property damage resulting from improper installation, use, or maintenance of a product
Personal injury resulting from failure to follow product instructions, warnings, or applicable codes
Delays in shipping or delivery caused by carriers or events outside Hunter's reasonable control

In jurisdictions that do not permit the exclusion or limitation of certain damages, Hunter's liability is limited to the fullest extent permitted by law.

To the fullest extent permitted by applicable law, Hunter's total cumulative liability to you for any claim arising out of or related to these Terms or the Services will not exceed the greater of (a) the amount you paid for the specific product giving rise to the claim or (b) one hundred US dollars ($100.00).

Nothing in this section limits liability that cannot be waived or capped under applicable law, including liability for fraud, gross negligence, or willful misconduct.

30. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to them or the Services will be governed by the laws of the State of California, without regard to its conflict of law principles.

Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California. You consent to personal jurisdiction in those courts.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending resolution of a dispute.
